These Terms of Service constitute a legally binding agreement between you and TranscribeNext.com. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

By creating an account, accessing, or using TranscribeNext.com's transcription services ("Service"), you agree to comply with and be bound by these Terms of Service ("Terms"), along with our Privacy Policy, which is incorporated by reference.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through a prominent notice on our Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

2. Eligibility and Account Registration

2.1 Age Requirement

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.

TranscribeNext.com provides AI-powered automatic transcription services that convert audio and video files into text.

3.2 Service Availability

We strive to provide continuous access to the Service, but we do not guarantee that the Service will be available at all times. We may temporarily suspend the Service for maintenance or updates.

3.3 Accuracy Disclaimer

Important: Our AI transcription service aims for high accuracy, but we do not guarantee 100% accuracy. Transcription quality may vary based on audio quality, accents, background noise, technical terminology, and other factors. You are responsible for reviewing and verifying all transcriptions for accuracy before use.

4. User Obligations and Acceptable Use

4.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms.

4.2 Prohibited Activities

You agree NOT to:

  • Upload content that infringes intellectual property rights of others
  • Upload illegal, harmful, threatening, abusive, harassing, defamatory, or obscene content
  • Upload content containing malware, viruses, or malicious code
  • Use the Service to violate any applicable laws or regulations
  • Attempt to gain unauthorized access to our systems or networks
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools (bots, scrapers) to access the Service without permission
  • Resell, redistribute, or sublicense the Service without authorization

4.3 Content Responsibility

You are solely responsible for ensuring you have the legal right to upload and transcribe all audio and video files. This includes obtaining necessary consent from all speakers in recordings where required by law.

5. Intellectual Property Rights

5.1 Your Content

You retain all ownership rights to the audio/video files you upload and the resulting transcriptions. By uploading content, you grant us a limited, non-exclusive, worldwide license to process, store, and display your content as necessary to provide the Service.

5.2 Our Intellectual Property

The Service, including all software, algorithms, designs, trademarks, logos, and other materials (excluding your content), are owned by TranscribeNext.com and protected by intellectual property laws.

6. Subscription and Payment Terms

6.1 Subscription Plans

We offer various subscription plans with different features and usage limits. Current pricing and plan details are available on our website.

6.2 Billing

  • Subscription Fees: Paid plans are billed monthly or annually based on your selection
  • Auto-Renewal: Subscriptions automatically renew unless canceled before the renewal date
  • Price Changes: We may change prices with 30 days' notice. Changes apply at your next renewal
  • Taxes: Prices exclude applicable taxes, which will be added to your invoice

6.3 Refund Policy

General Policy: All subscription fees (paid trials, monthly, and annual plans) are non-refundable, except when documented technical issues prevented the Service from functioning as described. One-time transcription credits are non-refundable once purchased.

Paid Trial Period:

  • We offer a paid trial period (typically 5 days) at a reduced rate to evaluate the Service
  • If you do not cancel before the trial ends, your subscription will automatically convert to the selected plan at the standard rate

Cancellation:

Upon cancellation of any subscription, you retain access to premium features until the end of your current billing period. No partial refunds are provided for unused time.

Technical Issues Refund (30-Day Window):

Refunds may be issued for any subscription type within thirty (30) days of the charge date if you experienced documented technical failures that prevented the Service from functioning as described.

To qualify for a Technical Issues Refund:

  • Eligible Issues: Service outages preventing file upload or processing, system errors causing transcription failures for files meeting our audio quality requirements, or account access issues caused by our systems
  • Evidence Required: You must provide screenshots showing error messages with timestamps, or other reasonable documentation of the technical issue
  • Support Contact Required: You must have contacted our support team at info@transcribenext.com and allowed up to 72 business hours for us to attempt resolution before requesting a refund

Not Eligible for Refund:

  • Transcription accuracy concerns (quality varies based on audio quality, accents, and background noise as disclosed in Section 3.3)
  • User errors, including uploading corrupted files or unsupported formats
  • Issues caused by your internet connection, browser, or device
  • General dissatisfaction after successful transcription processing
  • Requests made after the 30-day window from the charge date

How to Request a Refund:

To request a refund, email info@transcribenext.com with your account email, date of charge, reason for request, and supporting documentation (screenshots of errors). Requests are typically processed within 5-10 business days.

6.4 How to Cancel

You may cancel your subscription at any time through your account settings or by contacting us at info@transcribenext.com.

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimers and Limitations of Liability

8.1 Service "AS IS"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR AVAILABILITY.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRANSCRIBENEXT.COM SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless TranscribeNext.com, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from your use or misuse of the Service, your violation of these Terms, or your violation of any rights of another party.

10. Termination

10.1 Termination by You

You may terminate your account at any time. Termination does not relieve you of any payment obligations for services already provided.

10.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if you violate these Terms, your account is involved in fraudulent or illegal activity, or we are required to do so by law.

11. Dispute Resolution

11.1 Informal Resolution

Before filing a claim, you agree to contact us at info@transcribenext.com to attempt to resolve the dispute informally.

11.2 Jurisdiction

If informal resolution fails, any disputes shall be submitted to the exclusive jurisdiction of the courts located in Warsaw, Poland, except:

  • EU consumers may bring proceedings in the courts of their country of residence
  • Claims in small claims court in your jurisdiction

11.3 EU Online Dispute Resolution

If you are a consumer in the European Union, you may also use the Online Dispute Resolution (ODR) platform provided by the European Commission at https://ec.europa.eu/consumers/odr.

12. General Provisions

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Poland. For users residing in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence. For users residing in the United States, applicable state consumer protection laws may also apply to the extent required by law.

12.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TranscribeNext.com and supersede all prior agreements.

12.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

12.4 Force Majeure

We are not liable for delays or failures due to causes beyond our reasonable control, including natural disasters, wars, terrorism, pandemics, internet failures, or government actions.
